Jenni “JWoww” Farley’s husband wants prenup dismissed

Tennessee fans of the TV show “Jersey Show” may have heard that Jenni “JWoww” Farley filed for divorce from her husband of three years, Roger Mathews, in September 2018 on the grounds of irreconcilable differences. She asked for primary physical custody of their children with visitation rights for Mathews. She also asked for child support and that their prenuptial agreement be upheld.

In January, Mathews filed a petition in which he also asked for primary physical custody and child support. The petition requested joint legal custody and asked the court to create a schedule for custody and visitation. Mathews also requested alimony and asked that the prenup be dismissed as unenforceable although the filing did not give a reason.

The two have a 4-year-old daughter and a 2-year-old son. The separation has been contentious so far: Farley accused Mathews of abuse and of being a poor father. She shared videos and a letter on her website in which she accused Mathews of abusing her. In the videos, he appears to push her down during a fight, says he cheated on her and makes a joke while holding one of their children about using heroin.

Couples who want a prenuptial agreement should be careful about how they prepare it since a prenup can be dismissed in court in some circumstances. A judge will look at several elements to determine whether a prenup should be upheld. The agreement has to be reasonably fair. It can still leave the bulk of the assets with one person, but it should not leave the other person impoverished. If the prenup was signed right before the wedding, it could appear that one person was pressured into signing. Both parties must also have had adequate legal counsel.
